CAL HAULAGE LTD – Terms & Conditions

Acceptance of Terms

By instructing CAL HAULAGE LTD to provide any services, whether by telephone, email, text message, purchase order, quotation acceptance, or any other verbal or written instruction, the Customer confirms that they have read, understood, and accepted these Terms & Conditions, including the Cancellation Policy. These Terms & Conditions are available at all times on our website under the “T&Cs” section. By placing an order or requesting that work commences, the Customer agrees to be legally bound by them.

How We Work

We aim to provide a reliable, safe and professional transport service at all times.

All services provided by CAL HAULAGE LTD are carried out under these Terms & Conditions, which incorporate the Road Haulage Association (RHA) Conditions of Carriage (1998 Edition, as amended), being the recognised industry standard for road transport services within the United Kingdom.

RHA Conditions of Carriage

The RHA Conditions of Carriage govern the basis upon which goods are transported and set out the rights, responsibilities and limitations of liability applicable to both parties.

The RHA Conditions include limits on compensation in the event of loss of or damage to goods. A copy of the RHA Conditions of Carriage is available upon request.

Information and Responsibilities of the Customer

To ensure the safe and efficient provision of our services, the Customer shall ensure that:

* Goods are ready for collection at the agreed date and time;
* Goods are stable, safe and suitable for lifting, loading and transport;
* Accurate information regarding the nature, weight, dimensions and condition of the goods is provided;
* Access to collection and delivery sites is suitable and safe for our vehicles, cranes and equipment;
* Any special requirements, restrictions or hazards are communicated in advance.

The Customer shall be responsible for any additional costs, delays or losses arising from inaccurate information or failure to comply with the above requirements.

Job Information and Quotations

To enable us to provide an accurate quotation and plan the work efficiently, CAL HAULAGE LTD strongly recommends that all enquiries, instructions and job details are provided in writing and include all known information relating to the proposed works. This should include, where applicable, the nature of the goods, dimensions, weight, collection and delivery addresses, site access restrictions, photographs, lifting requirements and any specific requirements or potential hazards.

All quotations are prepared based on the information supplied by the Customer. Any omission, inaccuracy or subsequent change to the information provided may result in additional charges, revised pricing, delays or the inability to complete the services as originally planned. Providing complete and accurate information helps us deliver the safest and most cost-effective service and minimise unnecessary costs and delays.

Our Commitment

* Employ suitably trained and competent personnel;
* Use appropriately maintained and certified vehicles and equipment;
* Exercise reasonable skill and care in handling goods;
* Communicate professionally and keep the Customer informed;
* Use reasonable endeavours to meet agreed times and schedules.

Any times or dates provided are estimates only and shall not be of the essence of the contract.

Loading and Unloading

Unless otherwise agreed in writing, loading and unloading services shall be undertaken by CAL HAULAGE LTD personnel.

Where the Customer, its employees, contractors or representatives undertake or direct any loading or unloading operation, responsibility for that operation and any resulting loss, damage, delay or injury shall remain solely with the Customer.

Liability and Insurance

CAL HAULAGE LTD shall exercise reasonable care in the performance of its services. However, liability for loss of or damage to goods shall be subject to the limitations and exclusions contained within the RHA Conditions of Carriage.

CAL HAULAGE LTD maintains Goods in Transit insurance appropriate to the services provided. Additional insurance cover may be arranged at the Customer’s request and expense, subject to prior agreement.

Pricing and Payment

* All quotations and prices are based upon the information provided by the Customer at the time of booking.
* Additional charges may apply for waiting time, aborted visits, changes to the agreed scope of works, delays beyond our control or additional services requested on the day.
* Payment terms shall be as stated on the invoice unless otherwise agreed in writing.
* CAL HAULAGE LTD reserves the right to charge statutory interest and recover compensation and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation Policy

Any cancellation of services must be notified to CAL HAULAGE LTD in writing or by email.

* Cancellations made within 24 hours of the scheduled commencement time shall incur a cancellation fee of £250 plus VAT, which shall become immediately due and payable.
* Where the Customer cancels at shorter notice, or where the services cannot proceed due to any act, omission, delay, lack of access, inadequate site conditions or any other circumstance attributable to the Customer or the Customer’s representatives, CAL HAULAGE LTD reserves the right to charge a minimum of 80% of the agreed quotation value, plus VAT where applicable.
* CAL HAULAGE LTD further reserves the right to recover any additional losses, costs and expenses reasonably incurred as a result of such cancellation or inability to proceed with the services.
 

Governing Law and Jurisdiction

These Terms & Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from these Terms & Conditions or the services provided by CAL HAULAGE LTD.
